Typical Arbitration Cases and Practical Essentials of Valuation Adjustment Mechanism

The Shenzhen Court of International Arbitration (SCIA) has long been at the forefront of resolving disputes in the capital markets, having handled numerous cases involving valuation adjustment mechanisms (VAMs), commonly known as "bet-on" agreements. To aid industry professionals in understanding the adjudication trends of VAM disputes in arbitration and address gaps in the existing discussions, the SCIA has systematically reviewed and selected representative cases from recent years. After anonymizing the parties' information, scholars and practitioners were organized to conduct targeted analyses based on relevant regulations, including the Civil Code of the People's Republic of China and the Summaries of the National Conference for Work of Courts on the Trial of Civil and Commercial Cases.

Through this selection of typical arbitration cases, the publication aims to outline the full panorama of VAM disputes in arbitration, providing valuable references for the industry.
