Since its establishment in 1983, the Shenzhen Court of International Arbitration ("SCIA") has handled a large number of intellectual property dispute cases. Based on this, the SCIA was approved to establish the China (Shenzhen) Intellectual Property Arbitration Center ("IPAC") as one of its professional branches in 2021. The IPAC includes an Expert Committee composed of prominent intellectual property academics and experts, as well as 322 arbitrators specializing in high-tech industries and intellectual property rights, together representing 57 countries and regions. Since its establishment, the IPAC has handled cases covering all types of intellectual property arbitration cases, including patent, copyright, trademark, technology licensing and transfer, technology services, software development, etc., involving 16 countries and regions, such as the United States, Germany, Switzerland, Russia, Singapore, Japan and South Korea.
The IPAC is based in Shenzhen, linked to Hong Kong Special Administrative Region (SAR) and Macao SAR, facing the world, giving full play to the role of arbitration in "cross-border jurisdiction of cases, cross-border application of laws, cross-border enforcement of rulings, cross-border sharing of resources", and promoting the convergence of cross-border intellectual property dispute resolution rules and the connection of mechanisms, and is committed to providing domestic and foreign high-tech enterprises and other market players with independent, impartial, professional and efficient services for intellectual property dispute resolution.
Model Arbitration Clause 1:
Any dispute arising from or in connection with this contract shall be submitted to China (Shenzhen) Intellectual Property Arbitration Center for arbitration.
Model Arbitration Clause 2:
Any dispute arising from or in connection with this contract shall be submitted to the Shenzhen Court of International Arbitration (the SClA) for arbitration. The arbitration shall be conducted at the China (Shenzhen) Intellectual Property Arbitration Center.
