Application for the establishment of medical institutions

I. Overview

(1) Scope of application: 

This guideline specifies the accepting organization, the decision-making body, quantity limits, handling methods, type of matters reviewed, application conditions, application materials list, basic processes, time limits, results, result delivery and other requirements for the establishment and licensing of medical institutions.

This guide is applicable to persons applying for licensing of medical institutions in the administrative area of Chongqing.

(2) Accepting organization: Chongqing Municipal Health Commission.

(3) Decision-making body: Chongqing Municipal Health Commission.

(4) Quantity limit: Application for the establishment of tertiary general hospitals, specialized hospitals at the second level or above, traditional Chinese medicine institutions, rehabilitation hospitals, nursing institutions with social capital, and practicing physicians who meet the statutory conditions to apply for setting up clinics shall be approved in accordance with the Regulations on the Administration of Medical Institutions in Chongqing.

(5) Handling method: Online processing and processing in person at service window.

(6) Type of review: Approval after review.

(7) Legal time limit:

Approval for the establishment of medical institutions: 30 working days;

Approval for the establishment of wholly-owned hospitals by service providers from Hong Kong and Macao: 30 working days;

Licensing of medical institutions: 45 working days;

Verification of the License of Medical Institutions: 30 working days;

Registration of the change of the medical institution: 10 working days;

Cancellation of registration of medical institutions: 30 working days.

(8) Commitment time:

Approval for the establishment of medical institutions: 30 working days;

Approval for the establishment of wholly-owned hospitals by service providers from Hong Kong and Macao: 25 working days;

Licensing of medical institutions: 25 working days;

Verification of the License of Medical Institutions: 25 working days;

Registration of the change of the medical institution: 10 working days;

Cancellation of registration of medical institutions: 25 working days.

II. Application conditions

1. The applicant shall meet the local health plan and arrangement plan for medical institutions.

2. The applicant shall meet the basic standards of medical institutions, and have health professionals and professional technicians who are capable of operating medical technologies.

3. The Sino-foreign joint and cooperative medical institutions set up by service providers from Hong Kong and Macao shall meet the following conditions:

(1) they must be an independent legal entity;

(2) the total investment should not be less than 10 million yuan ($2.1 million);

(3) Hong Kong and Macao service providers should comply with the definitions of "service providers" and related provisions in the Mainland and Hong Kong Closer Economic Partnership Arrangement and the Mainland and Macao Closer Economic Partnership Arrangement respectively.

(4) The proportion or equity of the mainland party in a Sino-foreign joint or cooperative medical institution shall not be less than 30 percent;

(5) The time limit for joint ventures or cooperatives shall not exceed 20 years;

(6) Both Chinese and foreign parties applying for the establishment of Sino-foreign joint ventures or cooperative medical institutions shall be legal persons capable of independently bearing civil liability. The Chinese and foreign parties shall have direct or indirect experience in medical and health investment and management, and meet one of the following requirements:

1) Able to provide international advanced medical institution management experience, management modes and service modes;

2) Able to provide internationally leading medical technologies and equipment;

3) Able to supplement or improve local capabilities in medical services, technology, funding and facilities;

4. If the medical institution moves outside the jurisdiction of the original registration authority, it shall obtain an Approval Certificate for the Establishment of a Medical Institution issued by the health administrative departments of the migration destination;

III Application materials list 

(1) Source of materials 

The Application Form for Establishment of a Medical Institution can be obtained from the Administrative Examination and Approval Service Hall of the Chongqing Health Commission, or by logging onto the online administrative examination and approval hall of Chongqing Municipality (http://zwfw.cq.gov.cn), or by downloading the instructions and application form from the website of the Chongqing Health Inspection Bureau (http://www.cqwsjds.com). Other materials shall be provided by the applicant. 

(2) Material preparation 

All the materials are required to be printed on A4 paper, stamped with an official seal, and packed in the order set out below. Where the materials required to be submitted are copies, clear indication of "copy" shall be made, and the originals shall be provided for verification. 

(1) One copy of the Application Form for Establishment of a Medical Institution (The legal representative or responsible person of the applicant shall verify the materials item by item, and sign and affix the official seal of the unit);

(2) One copy of the feasibility study report (FSR). According to the 15 items of Article 15 of the Regulations for the Administration of Medical Institutions, the FSR includes the following contents:

1) Name and basic information of the application unit, and the applicant's name, age, resume, and ID card number;

2) Overview of population, economy and social development in the area;

3) The health status and epidemic situation of the population in the area and the prevalence of related diseases;

4) Analysis of the distribution of medical resources and medical service demands in the region;

5) Name, site selection, function, task and scope of services of the proposed medical institution;

6) The service mode, time, medical treatment subjects and registered beds of the proposed medical institution;

7) The organizational structure and staffing of the proposed medical institution;

8) Equipment for the proposed medical institution;

9) The relationship and impact of the proposed medical institution with other medical institutions within the service area;

10) The sewage and manure treatment plan of the proposed medical institution;

11) Information on communication, power supply, water and sewage, and firefighting facilities of the proposed medical institution;

12) Source of funds, investment method, total investment, registered capital;

13) The investment budget of the proposed medical institution;

14) Cost-benefit forecast analysis of the proposed medical institution within five years;

15) Credit certificate of the application unit or applicant.

(3) One copy of the site selection report. The location of the proposed medical institution shall not conflict with the regulations of the departments of environmental protection, forestry, fire protection, water conservancy, etc. The specific contents refer to:

1) Basis for site selection;

2) The environment and public facilities in the area where the site is located;

3) The relationship between site selection and the surrounding kindergartens, primary and secondary schools, and food production and operation units;

4) Land occupation and building area.

(4) One copy of the drawings of the architectural design:

1) It can reflect all the medical departments and functional rooms of the medical institution;

2) It can comply with the provisions of the Basic Standards for Medical Institutions (Trial).

(5) One copy of the proof of house property certificate and right to use or agreement on purchase of house or renting house;

(6) Credit proof of the application unit or the applicant, which shall be issued by the application unit or the applicant's deposit bank, and the credit proof shall be able to prove that the total investment meets the budgetary expenses;

(7) One copy of the identity certificate of the applicant and the business license of the application unit;

(8) A copy of the environmental protection approval document, which shall be issued by the environmental protection department within the administrative area where the medical institution will be set up;

(9) One copy of the verification form for the application of medical institution name:

1) The name of the medical institution approved by the competent department of health shall comply with the provisions of Articles 40-50 of the Regulations for the Administration of Medical Institutions;

2) The medical institution can only use one name. If it is necessary to use two or more names, it should be approved by the health authorities and the first name should be determined.

(10) One copy of the medical institution agreement shall be signed by all parties (the non-essential materials, unless it is jointly applied by two or more legal persons or other organizations for the establishment of a medical institution, shall not be provided).
