The Supreme People's Court (SPC) held a case study forum themed on "giving equal emphasis to punishment and governance, promoting high-quality development through enterprise compliance reform" on July 6.

As part of the SPC Judicial Case Academy's efforts to deepen the reform of case-related work, the forum has grown into a brand event and has held 30 sessions. The latest session selected four typical cases involving enterprise compliance reform that achieved political, social, and legal effects in the handling of those cases.

Zhang Jun, chief justice and president of the SPC, spoke highly of the forum in his speech and said it's "a feast of theoretical exchanges" to promote institutional innovation through new judicial practices. 

Heeding the issues raised and suggestions proposed at the forum, Zhang urged courts nationwide to better support the compliance reform of companies involved in cases by raising awareness of the reform's significance, promoting the principle of "judicial activism", and building a broader consensus on the task. 

He said courts should equally protect all kinds of market entities. For those micro, small and medium-sized enterprises whose operations are not compliant with rules, regulation and governance should be combined to guide them towards compliant operations. 

In addition to working with procuratorial organs to ensure criminal compliance, the people's courts should extend the boundaries of corporate compliance to civil and commercial affairs, administration, execution of judgments, and other fields. At the same time, they should also strive to achieve corporate compliance in different industries through  compliance in individual enterprises by issuing judicial recommendations and other means, Zhang noted. 

Zhang called for efforts to build broader consensus and emphasized the Party's leadership in the work. Third-party supervision and assessment mechanisms, case studies, and the joint efforts of legislative and academic organs to solve difficulties in practices were also mentioned in his speech.
