A Notice issued by the Supreme People's Court, the Supreme Procuratorate, the Ministry of Public Security and the Ministry of Justice about Opinions on Dealing with Domestic Violence Cases by Law

Updated:2016-06-23

Minors, the elderly, the disabled, pregnant or lactating women and the severely ill should be entitled to special protection. In cases of domestic violence, they should be better protected by being offered communication channels and  legal aid as required by law on a case-by-case basis so as to ensure their lawful rights and interests.

Strengthening legal aid to victims. The people's procuratorate, within three days of receiving the transferred files, and the people's court, within three days of accepting the files, should inform the victim and his or her legal agent or relatives who are entitled to file the case for the victim that if they are financially disadvantaged they can apply for legal aid. If the victim is a minor, elderly, severely ill or disabled and  cannot have a legal agent because of financial difficulties, the people's procuratorate and the people's court should help the victim apply for legal aid.

Legal aid institutions should offer legal aid to qualified victims according laws and appoint lawyers familiar with the laws and regulations against domestic violence to handle the case.
