XJTU Institute for International and Comparative Law proposed advice on the World Bank’s ICSID rules amendments

Recently, XJTU Silk Road Institute for International and Comparative Law (SRIICL) submitted a comprehensive proposal for the fourth amendment to arbitration rules to the World Bank's International Centre for Settlement of Investment Disputes (ICSID). ICSID Secretary-General, Meg Kinnear, specially replied with an appreciation letter. The proposal has been published on the official website of ICSID.

The XJTU SRIICL team led by professor Shan Wenhua has been focusing on the latest development of International Investment Law and has made remarkable progress. In 2018, professor Shan Wenhua was assigned by the Chinese government to serveas a mediator in ICSID. After comprehensive study of the ICSID Arbitration Rules Draft Amendments, professor Shan's team offered detailed advice on third party funding, appointment of arbitrators by the chairman, resignation of arbitrators, mediation rules and other issues. In addition, the team creatively proposed the establishment of a Permanent Annulment Committee to investigate problems in procedure and implementation of arbitration awards, especially to avoid the“inconsistency of awards”and other problems in international investment arbitrational system.
