Shanghai karaoke venue infringes music video copyright

Company Shanghai Xindar Catering Management Co Ltd was fined 120,000 yuan ($16,649) and ordered to cease unauthorized use of copyrighted karaoke music videos after a complaint from the China Audio-Video Copyright Association, or CAVCA. The complaint alleged that Xindar's karaoke venue played numerous pirated videos without permission.

On March 21, 2023, officials inspected Xindar's premises at No 299 Hengfeng Road, in the Jingan district of East China's Shanghai.

During the investigation in VIP Room V1, they verified that the karaoke system was used to play and fully queue copyrighted music videos, documenting this via photographs and song details.

The music videos are legally protected as audiovisual works and CAVCA manages the rights on behalf of the owners. Xindar's unauthorized screenings were found to have violated the copyright owner's exclusive rights to public performances, disrupting fair competition and the public interest.

The Shanghai Municipal Administration of Culture and Tourism, citing Article 53, Clause 1 of the Copyright Law of the People's Republic of China, sanctioned Xindar for infringing their rights and undermining the social and economic order.

The enforcement is said to underscore the rigorous protection of intellectual property in entertainment venues.
