Major rights enjoyed by customers who purchase goods with the “Three Guarantees”

As the joint name of repair, return and replacement, “Three Guarantees” is an important measure to safeguard the legitimate rights and interests of consumers. Purchasing goods with “Three Guarantees”, customers are likely to enjoy more fully protection of rights and interests. “Three Guarantees” goods in common market include bicycles, TV, home video recorders, cameras, tape recorders (including audio), keyboard (87 keys and above), household refrigerators (including freezers), washing machines, electric fans, microwave ovens, vacuum cleaners, household air conditioners, range hood, gas water heaters, sewing machines, watches and clocks (more than 50 RMB), motorcycles (including exclusively motor tricycle for the disabled), and other products. Consumers have the right to require sellers to bear the following responsibilities for their “Three Guarantees” goods:

(1) Within 7 days the products sold, consumers may choose to return, replace or repair their products with the occurrence of performance problems. When returning the products, the seller shall refund the one-off money identical with the invoice price.

(2) Within 15 days the products sold, consumers may choose to replace or repair the products with the occurrence of performance problems. When a replacing the products, the seller shall exchange the same model and specifications of the products without any extra charges.

(3) Within the period of validity of the “Three Guarantees”, if they still refuse to work smoothly after being repaired twice, sellers are responsible for exchanging the same model and specifications of the products without any extra charges, as long as customers provide repair records and proof, or return the products under requirement of (5).

(4) Within the period of validity of the “Three Guarantees”, if the products are not repaired from the date for repair over 90 days due to the lack of spare parts that shall be provided by the producer, the repairer should indicate in the repair situation, and the seller shall exchange the same model and specifications of the products without any extra charges on the basis of such indication. If the date of repair surpasses 30 days attribute to the repairer, the seller shall exchange the same model and specifications of the products for the consumers for free, and the costs shall be borne by the repairer.

(5) Within the period of validity of the “Three Guarantees”, if the products are in line with the replacement conditions, either the seller is short of the same model and specifications of the products, or the consumers are not willing to exchange for other models, the seller shall be returned; if there are products of the same model and specifications, but consumers are not willing to exchange for this product, the seller shall be returned. As for the products that have been used by consumers, the seller could charge with depreciation in accordance with relevant regulations. Depreciation is calculated only from the date of invoice to the date of return, which should be deducted occupancy and repair time for repairs.

(6) When customers replace the products, they shall not be provided with defective products, substandard products or repaired products. The date of the “Three Guarantees” valid for the replaced products shall be calculated from the replacement day, and the invoice shall be re-stamped in the back by the seller with new “Three Guarantees” certificate or the certificate shall be stamped in the back.
