Three Shanghai courts announce measures to strengthen services for Lin-gang Special Area

The Shanghai Third Intermediate People's Court, Shanghai Intellectual Property Court, and Shanghai Railway Transportation Intermediate Court issued 18 new measures to provide services for the construction of the new section of the China Shanghai Pilot Free Trade Zone (Shanghai FTZ) and further improve the local business environment.

The measures state that the courts shall prevent cross-border food and drug safety risks and environmental resource protection risks by using the "two-stage access" supervision model for goods entering the Lin-gang Special Area.

The courts shall offer judicial support for the implementation of the "separation of certificates and licenses" reform and the innovation of administrative measures in accordance with the law.

The adjudication of patent, copyright, trademark, and trade secret cases that may be involved in key industries of Lin-gang Special Area (including the integrated circuit Industry, artificial intelligence industry, biomedicine industry, and aviation and aerospace industry) should be strengthened.

The litigation docking mechanism will be improved to provide convenient and efficient judicial services for Lin-gang Special Area.

There are also measures on further strengthening the facilitation of bankruptcy trials.

The three courts set up a special collegial panel for IPR cases related to the Shanghai FTZ in 2016, and issued 16 measures to serve the construction of the Shanghai International Trade Center.

In 2018, they introduced 25 measures to serve the development of the investment environment and 12 measures to serve the construction of the Shanghai FTZ.
