Chapter III Facilitation of investment and operation

Article 11 (Opening-up in key areas)

Lin-gang Special Area will establish an open system to intensify opening-up in key areas such as telecommunications, insurance, securities, scientific research and technical services, education and health, ease restrictions on registered capital and investment modes to promote fair competition among various market entities, and will advance the industrial agglomeration of integrated circuits (IC), artificial intelligence (AI), bio-medicine, aerospace, new energy vehicles and high-end intelligent equipment.

Lin-gang Special Area will continuously expand the opening-up areas, pilot contents and corresponding institutional innovation measures according to the progress of pilot projects and the requirements for development.

Article 12 (Registration and confirmation system of commercial subjects)

Lin-gang Special Area will pilot a registration and confirmation system of commercial subjects. The registration authority shall conduct a formal examination of registration materials submitted by the applicant, make confirmation immediately after the approval, and issue the business license.

The applicant shall fulfill its obligations of truthful, complete and accurate declaration. The names of enterprises shall comply with the relevant national regulations, and shall not harm the national or social public interests, violate public order and custom or have any other adverse effect.

The registration authority shall withdraw the registration according to law if the applicant provides false materials, makes false promises or obtains registration through fraud, bribery or other improper means.

Article 13 (Settlement of Civil and Commercial Disputes)

After being registered by the municipal judicial departments and archived by the judicial department of the State Council, well-known foreign arbitration agencies and dispute settlement organizations may establish offices in Lin-gang Special Area to conduct arbitration on civil and commercial disputes arising in the fields of international commerce, the maritime sector and investment.
