Administrative measures for Lin-gang Special Area of the China (Shanghai) Pilot Free Trade Zone
Chapter II Administrative system
Article 5 (Administrative organization)
China (Shanghai) Pilot Free Trade Zone Lin-gang Special Area Administration (hereinafter referred to as the Administration), an agency of Shanghai municipal government, is responsible for the implementation of various pilot reform tasks in Lin-gang Special Area, economic management of Lin-gang Special Area and overall management and coordination of relevant administrative affairs in Lin-gang Special Area.
Article 6 (Institutional duties)
The Administration shall perform the following duties in accordance with the administrative measures:
(1) Organizing the implementation of development plans, policies and measures of Lin-gang Special Area, and formulating relevant administrative systems.
(2) Taking charge of the administrative management of investment, trade, financial services, planning resources, etc.
(3) Leading or coordinating the relevant administrative management of agencies located in Lin-gang Special Area, and establishing a mechanism of cooperation, coordination and joint law enforcement with agencies located in Lin-gang Special Area and relevant departments.
(4) Planning and promoting the development and construction of Lin-gang Special Area, guiding the industrial layout and function development of Lin-gang Special Area, and coordinating the construction of major investment projects.
(5) Carrying out the requirement of "services to be accessed via one website", implementing "internet plus government service" in an all-round way, and providing guidance, consultation and services for enterprises and related institutions in Lin-gang Special Area.
(6) Leading the administration of Nanhui New Town, making overall planning for the economic management of other towns in Lin-gang Special Area, and coordinating and administering the social affairs of Lin-gang Special Area in cooperation with relevant districts.
(7) Performing other duties granted by Shanghai municipal government.
Article 7 (Administrative approval and Punishment)
Lin-gang Special Area will implement a system and mechanism of comprehensive approval and relatively centralized administrative punishment. The Administration will exercise the relevant power of administrative approval power and administrative punishment in a centralized manner. Specific matters concerning the implementation of administrative approval and administrative punishment by the Administration shall be separately stipulated by the Shanghai Municipal People's Government.
Article 8 (Independent Reform and Innovation)
The Administration shall make full use of the independent development, reform and innovation authorities granted by the State Council to Lin-gang Special Area, and independently carry out innovative businesses to meet market demand under the premise of controllable risks.
Article 9 (Other administrative affairs)
The relevant municipal departments and district people's governments shall strengthen cooperation to support the reform and innovation of Lin-gang Special Area and the work of the Administration, and undertake administrative affairs beyond the scope of the Administration's duties in accordance with their respective functions and duties.
Article 10 (Authorized pilot institutions)
Lin-gang Special Area will establish pilot professional institutions authorized by law to undertake affairs such as public services, decision-making consultation and risk assessment, and will improve the level of public service and the quality of administrative decision-making.
