Notice of the Bureau of Construction and Transportation of Guangzhou Nansha New Area of China (Guangdong) Pilot Free Trade Zone on Issuing the Management Measures of Guangzhou Nansha New Area of China (Guangdong) Pilot Free Trade Zone of for Recognition of Qualifications of Hong Kong and Macao Engineering and Consulting Enterprises and Professionals

Hong Kong and Macao Enterprises and Professionals can directly provide services in Nansha New Area after registration with the construction administration department of Nansha New Area. If the registration documents are formed in Hong Kong and Macao, notarization and certification procedures will be needed. Organizations and professionals having completed registration with the housing and urban-rural construction department of Guangdong Province, Shenzhen Qianhai Shekou Area of China (Guangdong) Pilot Free Trade Zone (hereinafter referred to as "Qianhai Area") or Zhuhai Hengqin New Area of China (Guangdong) Pilot Free Trade Zone (hereinafter referred to as "Hengqin New Area") may submit their respective certification documents registered with such authorities as a substitute for the said notarization documents.

If the conditions for registration are met, the construction administration department of Nansha New Area shall handle the registration and mark the business scope according to the applicant's registration scope and performance in Hong Kong and Macao. The registration directory shall be published on the website of Nansha district people's government.

Hong Kong and Macao Enterprises and Professionals who have not been registered with the construction administration department of Nansha New Area and the housing and urban-rural construction department of Guangdong Province shall not directly provide services in Nansha New Area.

Article 9 After receiving the application documents submitted by Hong Kong and Macao Enterprises and Professionals, the construction administration department of Nansha New Area shall decide whether to approve the registration within five working days. If the registration is approved, a public announcement shall be made on the website of Nansha district people's government. In case of no objection during the publication period, a registration approval letter (see Appendix 4 for details) will be issued. If the registration is not approved, the reasons shall be provided to the applicant. The non-core application documents can be supplemented later within a limited time. The construction administration department of Nansha New Area shall inform the applicant of the contents to be supplemented at one time, and decide whether registration can be approved according to the supplemented documents.

In case of information change or renewal of registration approval documents, the legally registered Hong Kong and Macao Enterprises and Professionals shall submit a prescribed application form (see Appendix 5 for details). In case of expansion of the scope of registration, the notary documents for performance documents shall be submitted together.

After registration, Hong Kong and Macao Enterprises and Professionals shall also comply with the following principles when directly providing services to the market entities in Nansha New Area:

(I) If they are engaged in activities related to planning, surveying and mapping, they shall comply with relevant laws and regulations as well as the regulatory requirements of the industry authorities;

(II) The persons in charge of Hong Kong and Macao Enterprises in Nansha New Area shall have the identity as Hong Kong or Macao residents.
