Measures for Further Optimizing the Management and Service Mechanism to Improve the Efficiency of Industrial Land Use in Guangzhou Development District (Huangpu District)
In order to further improve the efficiency of industrial land use procedures, promote the efficient and intensive use of industrial land, put idle industrial land into use, and promote industrial transformation and upgrading, in accordance with the Regulations of Guangzhou Development District, Notice of the General Office of the Guangzhou Municipal People’s Government on Issuing the Implementation Measures for Improving the Efficiency of Industrial Land Use in Guangzhou (Sui Fu Ban Gui [2022] No. 5), Notice of the Guangzhou Municipal Planning and Natural Resources Bureau on Issuing (the 4th Batch of) Measures to Further Optimize the Approval Service Mechanism to Benefit Enterprises and the People and Promote Economic and Social Development and other relevant regulations, and combined with the Implementation Measures for Improving the Efficiency of Industrial Land Use in Guangzhou Development District (Huangpu District) (Sui Kai Gui Hua Zi Yuan Gui Zi [2022] No. 4) and the needs of actual work of Guangzhou Development District (Huangpu District) (hereinafter referred to as the “District”), the Measures are formulated (“Industrial Capacity Enhancement 2.0” for short).
Article 1 Optimizing investment agreements to accelerate the implementation of industrial investment. To apply for projects aimed at improving the efficiency of industrial land use, enterprises should sign investment agreements with government departments in charge of investment promotion, science and technology, industry and information technology, etc. in the District. The government departments may adjust the relevant provisions of the Investment Agreement (Sample Text) of Huangpu District/Guangzhou Development District on XX Project (Increasing the Floor Area Ratio of Existing Industrial Land) (Pu Zheng Shu [2023] No. 6) based on the requirements of relevant projects, but the following matters should be agreed upon:
1. Deadlines for the beginning and completion of a project. Within six months after the approval of a design plan, the excavation of the foundation pit, pile foundation construction and other substantive construction should be carried out on site, and reporting industrial investment in fixed assets to relevant statistical departments should be completed. A project should generally be completed within two years (relevant government departments may adjust the completion deadline or specify exceptions in the investment agreement based on the actual needs of the project).
2. Rental discounts. Within five years after a project is completed and put into operation, the enterprise shall provide rental discounts to projects introduced by the initiating government department(s) into the industrial park (relevant government department(s) shall specify the rental discounts when signing the investment agreement based on the actual needs of the project). For investment projects of state-owned enterprises, rental discounts shall comply with the requirements of relevant state-owned assets supervision and administration authorities.
Article 2 Promoting the capacity and production expansion of real-economy projects. For enterprises that need to apply to improve the efficiency of industrial land utilization for the purpose of technological upgrades, transformation, capital increase and expansion, etc., their needs for factory construction and design in terms of story height, load, standard floor area, and others shall be supported in accordance with laws and regulations.
Article 3 Accelerating the development and construction of industrial parks. Incubators, accelerators, and characteristic industrial parks planned or recognized by government departments of the District in charge of development and reform, investment promotion, science and technology, industry and information technology, etc. can apply to improve the efficiency of industrial land utilization and build industrial parks for factory rental. In principle, such industrial parks should plan and construct high-standard factory buildings that account for no less than 40% of the total construction area, and adopt high-standard design in terms of story height, load, and standard floor area (For details, see the appendix “Basic Requirements for High-Standard Factory Construction”).
Article 4 Ensuring that the existing industrial land is developed in accordance with previous approvals. For existing industrial land that has completed land use approval procedures according to law, met planning conditions, obtained approval for its general layout plan or a detailed construction plan that is still valid, and has conditions for implementation, if it is changed into other land properties not to be constructed in the near-to-medium term, the District’s administrative approval department shall, with the consent of the planning department and other relevant departments, may directly accept the subsequent construction application procedures based on the valid approval documents, with no need to handle the procedures for modifying the detailed land spatial planning.
Article 5 Optimizing the procedures to promote the resolution of historical issues in the planning of existing industrial land. For existing industrial land that has completed land use approval procedures according to law, whose detailed planning has been adjusted but will not be implemented in the near-to-medium term, it shall be handled in accordance with the following methods if the land user applies to continue constructing it as industrial land:
1. For land parcels that could be included in a regulatory plan, after the regulatory plan is reviewed by experts, the District’s planning and natural resources bureau shall issue planning requirements, and enterprises are exempt from submitting capacity improvement feasibility assessment materials. The District’s administrative approval department shall directly issue approvals based on the planning requirements.
2. For land parcels having met planning conditions or obtained approval for the overall plan or detailed construction plan that is still valid, if its industrial project plot ratio and other planning indicators need to expand the previously approved indicators, relevant government departments shall inform the District’s administrative approval department of this matter by letter. Upon notification, the District’s administrative approval department shall take the lead in soliciting opinions from relevant departments in charge of ecology and environment, planning and natural resources, housing and urban-rural development, water affairs, emergency management, as well as relevant sub-districts, towns, and industrial parks, and handle them in a classified manner:
If there are no substantial objections from any department, the District’s administrative approval department shall directly examine and approve the capacity improvement application according to the purpose of land use;
If relevant departments raise substantive objections, the District’s administrative approval department shall submit them to district-level meetings for review. After the matter passes the review, the District’s administrative approval department shall directly examine and approve the capacity improvement application according to the purpose of land use and then the District’s planning and natural resources bureau shall implement it in conjunction with detailed plans.
Article 6 Improving the planning indicators for industrial land. The District’s planning and natural resources bureau shall adjust indicators such as plot ratio, building density, green space ratio, and building height (not exceeding 100 meters) for industrial zones and rural industrial agglomeration blocks in the entire District in a unified manner. For projects applying to improve the efficiency of industrial land use, if the plot ratio meets the adjusted indicator, there is no need for the enterprise to separately entrust a technical institution to prepare a control and regulation revision plan for demonstration. The District’s administrative approval department shall directly handle the planning approval.
Article 7 Optimizing the procedures for supplementing contracts for the transfer of land use rights. For projects that have been approved to improve the efficiency of industrial land use, the land use right holder shall sign a supplementary contract to the land use right transfer contract with the District’s planning and natural resources bureau based on the approval documents of the planning and design scheme. The investment agreement that specifies the completion deadline and rental discounts shall be attached as an annex to the supplementary contract. After submitting the relevant materials required for the signing of the supplementary contract for the land use right transfer contract to the District’s planning and natural resources bureau, the land use right holder shall simultaneously apply to the District’s administrative approval bureau for the issuance of the construction project planning permit.
Article 8 The Measures shall come into force from the date of issuance and will remain in effect for five years. If any provision is inconsistent with the Implementation Measures for Improving the Efficiency of Industrial Land Use in Guangzhou Development District (Huangpu District) (Sui Kai Gui Hua Zi Yuan Gui Zi [2022] No. 4), the Measures shall prevail. If there are any adjustments or changes to laws, regulations, rules or relevant national, provincial or municipal policy documents during the validity period of the Measures, their provisions shall prevail.
